In the Matter of BABY M, a Pseudonym for an actual person, 109 N.J. 396 (1988)(New Jersey Supreme Court)

Harold Cassidy was Chief Counsil in the historic Baby M case, to represent the Surrogate Mother who sought to have the Surrogacy Contract declare unjustified. As the first certified surrogate mother contract case in the nation, the court at Cassidy's urging, struck down the contract as uninforaceable, contrary to the public policy, and exploitative of women. The powerful and poetic opinion of the unanimous Supreme Court, written by Chief Justice Robert Wilentz, influenced development of the law throughout the world and was taught in law schools accross the country.

The A.G.R Case

Harold Cassidy successfully represented a surrogate mother in the first certified "gestational" surrogacy case in New Jersey. The court struck down the contract as unjustified, violative of public policy and exploitive of women. The opinion follows.
